Research Notes on Unapproved Drugs and Medicaid


Since 2004, at least $200 million has been spent on medications that have never been reviewed for safety and effectiveness, but are still covered by Medicaid. Currently, dozens of deaths can be linked to the use of these drugs.1 More than 100 unapproved drugs have been paid for (between the years of 2004 and 2007), including pain and cold medicines.2 Data from 2008 has not yet been released.1

  • Medications were checked against US Food and Drug Administration (FDA) databases.1
  • Officials from Medicaid have acknowledged that this is a problem, but state they need help from Congress to fix it.1
  • The FDA estimates that 2 percent of all prescriptions are unapproved medications.1
  • These are mostly medications that were widely prescribed before the FDA started their strict regulatory and approval process in the 1960s.2
