Research Notes on Psychotherapy, Personal Notes, and HIPAA
Psychotherapy notes are defined as: notes recorded in any medium by a mental health care provider who is documenting or analyzing the contents of conversation during a counseling session.1 Medication prescriptions, session start and stop times, results of clinical tests, and frequency of treatments are not considered to be psychotherapy notes. Personal notes are the practitioner's impressions, observations, and speculations of the patient.1

- Psychotherapy and personal notes may not be disclosed without authorization.2
- These notes may be disclosed to authorities if serious harm to someone will take place.2
- HIPAA permits psychiatrists to deny patients access to the notes.3
