Research Notes on ADHD/ADD Student Rights
In most states, children with ADHD/ADD are generally not considered to be special needs children.1 Therefore, their rights as students fall under the basic constitutional rights of all students.2 Other factors may be used to determine whether a child with ADHD/ADD qualifies for special education.1 Those factors can include grades, dyslexia, or other qualifying disabilities.

- Children have the right to receive free and appropriate education.
- Parents should confer with their child's counselor regarding their rights.3
